Our mortgage was discharged in a bk but we still live in it and make monthly payments. We currently are in month two of a 3 month forbearance, ending July 1. Will the bk disallow the servicer from working with us when we ask for the 3 months to be put at end of loan?

Hi Patrick, thank you for your question. The fact that your mortgage debt was discharged should not prevent you from qualifying for a deferment because your loan is already in the loss mitigation department of your servicer. You definitely need to have this conversation with our servicer. The only thing I can think that may come up is that your mortgage if modified (deferment), may reinstate the loan, removing it from Bankruptcy protection. And this means that if your mortgage is no longer under bankruptcy protection, and you should default in the future, it will be reported on your credit report and prevent you from buying for some period of time.
